The arbitration shall take place in New York, New York. Each party shall bear its own costs unless the arbitrator determines otherwise.

Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

You agree to resolve disputes with Kodesh Press on an individual basis only and waive any right to participate in a class action lawsuit or class-wide arbitration.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in New York, New York.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kodesh Press and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of another party.
